Terms of Service

These Terms of Service ("Terms") are the agreement between you and Erbacci LTD ("Erbacci", "we", "us") for your use of MomentReel — the web app at momentreel.erbacciltd.com, the MomentReel listing on the Ring Appstore, and the backend service behind them (together, the "Service"). By linking your Ring account to MomentReel or otherwise using the Service, you accept these Terms. If you do not accept them, do not use the Service.

How we handle your data is described in the Privacy Policy, which forms part of these Terms.

1. Eligibility and territory

You must be at least 18 years old. The Service is offered in the United States only, and we do not make it available anywhere else.

You may connect only Ring cameras that you own or are lawfully authorised to control, on property you own or lawfully control. You are responsible for complying with the laws that apply where your cameras are — including notice and consent rules for recording people, and the recording laws of your state.

2. What MomentReel does

MomentReel reads the motion events your cameras already recorded, judges by machine whether any of them look like a moment worth keeping, and builds you a small private library of short clips. You can trim a clip, crop it to a vertical, square or widescreen shape, add a caption and a music bed, blur faces, and export a finished MP4 to your own device.

MomentReel cannot make a camera record. It only retrieves footage the camera captured on its own; if the camera was idle, the clip does not exist and cannot be created. MomentReel does not post anything anywhere. When you export a clip, you get a file — what happens to it next is entirely up to you.

Ring burns an overlay into every image and clip it serves. Our renderer crops the top band out of the file it produces, as a compositional choice about our own output. We do not remove, disable, circumvent, inpaint or otherwise interfere with the overlay Ring applies.

3. MomentReel is not a security or life-safety product

This is the most important sentence in this document. MomentReel is an entertainment and keepsake tool. It is not a security system, an alarm, a monitoring service, a safety device, or any part of one, and it must not be relied on as though it were.

Never treat the presence or absence of a MomentReel clip as evidence that something did or did not happen. Most motion events are deliberately discarded — that is the entire point of the product.

4. Your Ring account

MomentReel works only once you link your Ring account. Linking is one-way: it lets us read device information, retrieve recorded media, and receive event and subscription notifications for the cameras you enable. It grants us nothing on your Ring account beyond that.

You can revoke the link at any time from the Ring app. When you do, we permanently delete your stored clips, exports, records and Ring tokens, as described in the Privacy Policy. Your access to MomentReel depends on your Ring account remaining in good standing and on your Ring devices remaining eligible.

5. Your content, and what you do with it

The clips MomentReel builds come from footage recorded by your cameras. As between you and us, that footage and the clips and exports made from it are yours. We claim no ownership of them.

You grant us only the narrowly scoped licence we need to run the Service: to retrieve, store, analyse by machine, transform, render and deliver your media, for you, for as long as we hold it under the retention rules in the Privacy Policy. That licence ends when the data is deleted, and it covers nothing else — in particular, we do not use your footage to train any model and we do not use it for marketing.

You are solely responsible for what you export and where you share it. Exporting a clip is a deliberate act, and publishing it is another one. Before you share a clip, it is on you to make sure that doing so is lawful and fair, in particular where the clip shows:

Face blurring is on by default on every export. If you switch it off for an export, you are making an informed decision to publish an identifiable image of whoever is in it, and you accept responsibility for that decision. You agree to indemnify Erbacci against any claim brought by a third party arising out of a clip you exported or shared.

All billing runs through the Ring Billing System. We do not take payments ourselves, never see your card details, and offer no other way to pay. The price is shown on the MomentReel listing on the Ring Appstore before you are charged ([CONFIRM] — monthly price in USD).

Terms of the subscription:

If we ever need to remove or materially reduce a paid feature, we will give you notice before it takes effect.

8. The music library

Music tracks offered inside MomentReel are licensed to us for use in clips created and exported through the Service ([CONFIRM] — music library provider and licence terms). You may use them in your exported clips. You may not extract, redistribute, resell or use them separately from a clip you exported, and we make no representation that any particular platform will accept a clip containing them.

9. Availability, and no warranty

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent the law allows.

In particular, and these are expected behaviours, not defects:

We do not warrant that the Service will be uninterrupted, timely or error-free, or that any particular moment will be found, kept, rendered or delivered.

10. Limitation of liability

To the maximum extent permitted by law, Erbacci LTD will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or media, arising out of or connected with the Service — including any loss connected to a moment that was not captured, not kept, deleted on schedule, wrongly judged, or delivered late, and including any consequence of a clip you chose to export or share.

Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim arose, and (b) fifty US dollars (USD 50).

Some jurisdictions do not allow certain exclusions or limitations; where that is so, the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms limits liability that cannot lawfully be limited.

11. Termination

You may stop using the Service at any time and delete your account from Account → Delete account inside the app; deletion is immediate and permanent, as described in the Privacy Policy. Unlinking MomentReel from your Ring account has the same effect on your stored data.

We may suspend or terminate your access if you breach these Terms, if we are required to by Ring or by law, or if we discontinue the Service. If we discontinue the Service, we will give you reasonable notice so you can export the clips you want to keep.

12. Changes to these Terms

We may update these Terms. Material changes — including changes to what the Service does, how it uses your data, or what a subscription includes — require re-certification with Ring, and we will tell you in the app before they take effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, excluding its conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Wyoming, unless consumer protection law where you live gives you a non-waivable right to a different forum. Nothing here affects any right you have to bring a complaint to a regulator.

Use the same address for support, for a data request, or to report abuse of the Service by anyone, including a clip that you believe should never have been shared. We aim to respond within 2 business days.
